中国联合航空会员注册须知
CUA Member Registration Instructions
为使用户安全、方便地买机票，中国联合航空有限公司（以下简称“中国联航”）特推出电子客票服务。用户（旅客）在注册成为中国联航会员之前，请仔细阅读以下服务条款，当您确认全部接受协议内容并同意在以后的网上活动中遵守其所有条款，方可完成网上购票。
In order allow our users to safely and conveniently purchase air tickets, China United Airlines (CUA) has launched the E-ticket service. Users (passengers) please carefully read the following service terms and conditions prior to registering as CUA members, and you have to agree to and abide by all the terms and conditions of the Agreement in your future online activities before you can purchase air tickets online.
中国联合航空官网各项服务的所有权与运作权归中国联航所有。本服务条款具有法律约束力。如果您点选“注册”并通过注册程序，即表示您自愿接受本协议之所有条款，并已成为中国联航的注册会员。注册会员需遵守《中华人民共和国民用航空法》。本服务条款中的标题仅为方便而设，在解释本服务条款时应被忽略。
The ownership and operational rights of all the services on the CUA official website belong to China United Airlines. These service terms and conditions are legally binding. When you click on "Register" and complete the registration procedures, you voluntarily accept all the terms and conditions of this Agreement and become a registered CUA member. Registered members must comply with the Civil Aviation Law of the People's Republic of China. The headings of the service terms and conditions are for reference only and their meaning shall be disregarded in interpretation.
第一项：关于对中国联航网络服务内容的确认
Article One, Confirmation of the Contents of CUA Network Services
中国联航向其会员提供相关网络服务，与相关网络服务有关的设备（如个人电脑、手机、及其他与接入互联网或移动网有关的装置）及所需的费用（如为接入互联网而支付的电话费及上网费、为使用移动网而支付的手机费）均由会员自行负担。
CUA provides its members with the relevant network services, and all members shall be responsible for the relevant devices (e.g., PCs, cell phones and other devices used to access the Internet or mobile networks) and necessary expenses (e.g., telephone fees, Internet access fees and cell phone fees for mobile network connection) in relation to such network services.
第二项：关于对会员帐号及密码设置的确认
Article Two, Confirmation of Member Account and Password Setting
您使用手机、邮箱注册会员成功后，您可以设置用户名，您的会员用户名、手机号、邮箱即可成为登录帐号，并将得到（或设置）一个登录密码。您应妥善保管帐号及密码，并对帐号进行的所有活动及事件负法律责任。因黑客行为或会员保管疏忽致使帐号、密码被他人非法使用的，中国联航不承担任何责任。如您发现任何非法使用会员帐号或安全漏洞的情况，请立即与中国联航联系。
After successful registration of your membership by cell phone number or E-mail, you can set up a user name, and use your user name, cellphone number or E-mail to log on your account, and you will get (or set up) a login password. You should keep your account number and password secure also you are legally responsible for all activities and events in your account. In case of unauthorized use of the account number and password due to hacking or the member's negligence, CUA will assume no responsibilities. If you discover any unauthorized use of a member account or any security vulnerabilities, please do not hesitate to contact CUA.
会员账号注销后，会员使用服务的权利同时终止。自会员服务终止之时起，中国联航不再对该会员承担任何责任。
When a member account is cancelled, the member's right to use the service is also terminated. Once the member service is terminated, the CUA will no longer assume any responsibility for such a member.
第三项：关于对会员权责的确认：
Article Three, Confirmation of Members' Rights and Responsibilities:
1.会员有权按照中国联航的程序和要求使用各项网络服务，如果会员对该服务有异议，可以与中国联航联系以便得到及时解决。
1. All members shall have the right to use the network services in accordance with CUA's procedures and requirements. In case of any disagreement with such services, please contact CUA for a prompt solution.
2.用户在申请使用中国联航网络服务时，必须向中国联航提供准确的个人资料，如个人资料有任何变动，必须及时更新。
2. Users are required to provide CUA with accurate personal information when applying for the use of CUA network services, and update it promptly in case of any changes.
3.会员须同意接受中国联航通过电子邮件或其他方式向会员发送促销或其他相关商业信息。
3. All members shall agree to receive CUA promotional and other relevant commercial information sent via E-mail or other channels.
4.会员在中国联航的官网上发布信息或者利用中国联航官网的服务时必须符合国家的法律法规以及国际法的有关规定。
4. When publishing information on CUA official website or using CUA official website services, all members must abide by the State laws and regulations and the relevant provisions of the international law.
5.对于会员通过中国联航官网消息平台上传到中国联航官网可公开获取区域的任何内容，会员同意授予中国联航在全世界范围内享有完全的、免费的、永久性的、不可撤销的、非独家的权利，以及再许可第三方的权利，以使用、复制、修改、改编、出版、翻译、据以创作衍生作品、传播、表演和展示此等内容（整体或部分），和/或将此等内容编入当前已知的或以后开发的其他任何形式的作品、媒体或技术中。
5. All members shall agree to grant CUA the full, free, permanent, irrevocable and non-exclusive right as well as the right to relicense for third parties to use, reproduce, modify, adapt, publish, translate, create derivative works, communicate, perform and display all or part of, and/or compile in any known or any other future forms of works, media or technologies of any contents that they may upload through CUA BBS platform onto the CUA official website spaces that are open to public access.
6.会员承诺不会在中国联航的消息平台发布如下信息：
6. All members shall agree not to publish information on CUA's BBS platform if the information may do the following:
(1) 反对宪法所确定的基本原则的；
(1) oppose the general principles established in the Constitution;
(2) 危害国家安全，泄露国家秘密，颠覆国家政权，破坏国家统一的；
(2) jeopardize national security, disclose national secrets, overthrow the regime, or sabotage the national unification;
(3) 损害国家荣誉和利益的；
(3) hurt national honor and interests;
(4) 煽动民族仇恨、民族歧视，破坏民族团结的；
(4) incite national hatred and discrimination and undermine national unity;
(5) 破坏国家宗教政策，宣扬邪教和封建迷信的；
(5) damage the national religious policies and advocate cults and superstitions;
(6) 散布谣言，扰乱社会秩序，破坏社会稳定的；
(6) spread rumors, disrupt public order and undermine social stability;
(7) 散布淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪的；
(7) disseminate filthy, pornographic, gambling, violent, murdering, terrorist contents or incite crimes;
(8) 侮辱或者诽谤他人，侵害他人合法权益的；
(8) insult or slander others, infringe on the legitimate rights and interests of others;
(9) 含有法律、行政法规禁止的其他内容的。
(9) contain any other content that is prohibited by laws and administrative regulations.
7.会员单独为其发布在中国联航官网上的信息承担责任。会员若在中国联航官网和传播违法信息，网络会员服务的系统记录有可能作为会员违法之证据。
7. All members shall be solely responsible for the information they release on the CUA official website. If a member disseminates illegal information on the CUA official website, the system records of the network services will probably be used as evidence against such a member.
8.会员不得利用本站的服务从事以下活动：
8. No members shall use the services of this website to carry out the following activities:
(1)未经允许，进入计算机信息网络或者使用计算机信息网络资源；
(1) entering the computer information network or using the computer information network resources without permission;
(2)未经允许，对计算机信息网络功能进行删除、修改或者增加；
(2) deleting, modifying or adding computer information network functions without permission;
(3)未经允许，对进入计算机信息网络中存储、处理或者传输的数据和应用程序进行删除、修改或者增加；
(3) deleting, modifying or adding data and applications that are stored, processed or transmitted in the computer information network without permission;
(4)故意制作、传播计算机病毒等破坏性程序；
(4) intentionally making and spreading computer viruses and other destructive programs;
(5)其他危害计算机信息网络安全的行为。
(5) any other acts detrimental to computer information network security.
9.会员不得以任何方式干扰本站的服务。
9. No members shall in any way interfere with the services of this website.
10.会员承诺遵守本站的所有其他规定和程序。
10. All members shall agree to comply with all other provisions and procedures of this website.
11.如果会员违反上述规定，中国联航有权要求其改正或直接采取一切必要措施（包括但不限于更改或删除会员发布的信息、中断或终止会员使用网络的权利等），以减轻会员不当行为所造成的影响。
11. In case of any breach by any member of the provisions above, CUA shall have the right to request correction or take all necessary steps directly (including but not limited to modifying or deleting the information released by such a member, suspending or terminating the member's right to use the network, etc.) to mitigate the effects of such a member's misconduct.
第四项：关于对服务条款及内容进行修改或中断的确认
Article Four, Confirmation of Modification or Suspension of Service Terms and Conditions
1.中国联航有权在必要时修改本服务条款，服务条款的内容一旦发生变动，中国联航将会通过适当的方式向会员提示修改内容。中国联航和以最新服务条款为准向会员提供服务并承担相应义务。
1. CUA may modify these service terms and conditions when necessary, and such modifications will be notified to CUA members in an appropriate manner. And CUA will provide services to CUA members and undertake obligations according to the latest service terms and conditions.
2.鉴于网络服务的特殊性，中国联航保留随时修改或中断其部分或全部网络服务的权利，并无需通知会员或为此对会员及任何第三方负责。
2. In view of the special nature of network services, CUA reserves the right to modify or suspend part or all of the network services at any time without prior notice to the members or assuming therefore any responsibilities to its members any third parties.
第五项：关于对会员隐私保护事项的确认
Article Five, Confirmation of the Protection of Members' Privacy
中国联航尊重会员的隐私权，不会公开、编辑或泄露任何有关会员的个人资料以及会员在使用网络服务时存储在中国联航的非公开内容，但以下情况除外：
CUA respects its members' right of privacy, and will not disclose, edit or reveal their personal data and the contents that they may, when using the network services, store with CUA and are not intended for public view, unless:
1.事先获得会员的明确授权；
1. authorization is obtained directly from the member in advance;
2.遵守法律规定或中国联航官网合法服务程序；
2. in accordance with the law or the lawful service procedures of CUA's official website;
3.按照相关政府主管部门的合理要求；
3. the relevant government authorities reasonably requested ;
4.维护社会公众利益；
4. the public interest is at stake;
5.维护中国联航的合法权益；
5. the legitimate rights and interests of CUA are at stake;
6.符合其他合法要求。
6. in compliance with other legal requirements.
第六项：关于对中断或终止会员服务的确认
Articles Six, Confirmation of Suspension or Termination of Member Services
如发生下列任何一种情形，中国联航有权随时中断或终止向会员提供本协议项下的网络服务，而无需对会员或任何第三方承担任何责任。
CUA may suspend or terminate at any moment the network services to any member under this Agreement and will not assume any responsibilities to such a member or any third parties, if
1.会员向中国联航提供的个人资料不真实。
1. Such a member has provided false personal information to CUA.
2.会员违反本协议的规则或不履行其所承担的义务。
2. Such a member violates the rules of this Agreement or fails to perform its obligations.
除此之外，会员可随时根据需要通知中国联航终止向该会员提供服务，会员服务终止后，会员使用服务的权利同时终止。自会员服务终止之时起，中国联航官网不再对该会员承担任何责任。
I addition any member may at any time notify CUA to terminate services to him/her as he/she thinks fit, and upon termination of the member’s service, the member's right to use the services is also terminated at the same time. Once the member’s service is terminated, the CUA official website will no longer assume any responsibility for such a member.
第七项：关于对知识产权的确认
Article Seven, Confirmation of Intellectual Property Rights
1.中国联航在网络服务中提供的任何文本、图片、图形、音频和视频资料均受版权、商标权以及其他相关法律法规的保护。未经中国联航事先同意，任何人不能擅自复制、传播这些内容，或用于其他任何商业目的，所有这些资料或资料的任何部分仅可作为个人或非商业用途而保存在某台计算机内。
1. All texts, pictures, graphics, audio and video data provided by CUA in network services are protected by copyrights, trademark rights and other relevant laws and regulations. No person shall, without the prior consent of CUA, copy or transfer these contents or use such contents for any other commercial purposes. Such data or any part of it can only be stored in a computer for personal or non-commercial purpose.
2.中国联航为提供网络服务而使用的任何软件（包括但不限于软件中的任何文字、图形、音频、视频资料及其辅助资料）的一切权利属于该软件的著作权人，未经该著作权人同意，任何人不得对该软件进行反向工程、反向编译或反汇编。
2. All rights of the software (including but not limited to any texts, graphics, audio and video data and auxiliary data contained in the software) that CUA uses to provide network services belong to their copyright owners, and no person shall, without the prior consent of the copyright owner, reverse engineer, decompile or disassemble such software.
3.所有发给会员的通告都可以通过重要页面的公告、电子邮件以及常规信件的形式传送。
3. All notices to members may be delivered via bulletins on important web pages, E-mails or regular mail.
第八项：关于对免责事项的确认
Article Eight, Confirmation of Disclaimer
1.中国联航对任何因会员不正当或非法使用服务、在网上进行交易、或会员传送信息变动而产生的直接、间接、偶然、特殊及后续的损害不承担责任。
1. CUA shall not be responsible for any direct, indirect, incidental, unusual or consequential damages resulting from any improper or illegal use of services, transactions on the Internet or changes of information during transfer by any members.
2.中国联航对任何他人的威胁性的、诽谤性的、淫秽的、令人反感的或非法的内容或行为或对他人权利的侵犯（包括知识产权）不承担责任；并对任何第三方通过服务发送或在服务中包含的任何内容不承担责任。
2. CUA shall not be responsible for any threatening, libellous, pornographic, disgusting or illegal contents or conducts, or infringement of rights (IP rights included) by any other parties; or any contents that any third party transmits through services or included in such services.
3.会员明确同意其使用中国联航官网服务所存在的风险以及使用中国联航官网服务产生的一切后果由其自己承担。
3. All members expressly agree to undertake any risks that may exist in the use of CUA's official website services as well as the consequences that may arise from the use of such services.
4.对于因不可抗力或中国联航不能控制的原因造成的网络服务中断或其它缺陷，中国联航官网不承担任何责任，但将尽力减少因此而给用户造成的损失和影响。
4. CUA shall not be responsible for any interruption or other defects in the network services caused by Force Majeure or factors beyond CUA's control, but will make every effort to reduce the loss and impact thus caused to the user.
5.中国联航不对所提供之网络服务做任何类型之担保，包括但不限于：
5. CUA does not give guarantees in any way for its network services, including but not limited to:
(1)网络服务一定能满足会员要求；
(1) the network services are sure to meet requirements of the members;
(2)网络服务不会中断；
(2) the network services will never be interrupted;
(3)网络服务的及时性、安全性、准确性。
(3) the network services will be prompt, safe and accurate.
第九项：关于对法律责任的确认
Article Nine, Confirmation of Legal Liabilities
1.因会员对本服务之使用而导致中国联航遭受任何来自第三方之纠纷、诉讼及索赔要求，会员同意向中国联航及其关联企业、职员赔偿相应损失（包括合理的律师费），并尽力使之免受损害。
1. All members agree to compensate for the losses (reasonable attorney's fees included) to CUA, its associated enterprises and employees and make every effort to avoid any damages if any member's use of this service gets CUA involved in any disputes, litigations or claims for compensations by any third parties.
2.中国联航服务条款之效力、解释、执行均适用中华人民共和国法律。如发生争议，应提交至有管辖权之人民法院。
2. The validity, interpretation and execution of the terms and conditions of CUA services shall be governed by the laws of the People's Republic of China. Any dispute, if any arise, shall be submitted to the people's court with jurisdiction.
第十项：中国联航会员义务
Article Ten, Obligations of CUA Members
1. 会员义务
1. Obligations of Members
(1) 会员注册后购票后不得恶意占座；
(1) Registered members having booked their tickets shall not hold seats out of ill intentions;
(2) 注册会员不得出现利用中国联航官网倒买倒卖机票、或其它航空产品行为；
(2) Registered members shall not make use of CUA official website to trade air tickets or any other air products;
(3) 注册会员不得使用非正常手段（包括但不限于刷票软件），抢购特价机票；
(3) Registered members shall not use illicit means (including, but not limited to ticket hacking software) to purchase budget tickets;
(4) 注册会员不得出现恶意攻击中国联航官网的行为；
(4) Registered members shall not intentionally attack the CUA official website;
2.发生以下行为，注册会员账户停用一个月内：
2. The account of a registered member will be suspended for one month, if:
(1)使注册会员信息购票后，发现至少一次恶意占座的；
(1) the registered member, after purchasing air tickets, is found to have at least once held seats out of ill intentions;
(2)使用非正常手段（包括但不限于刷票软件），同时抢购多张特价机票，扰乱中国联航官网秩序的；
(2) the registered member uses illicit means (including but not limited to ticket hacking software) to buy more than one budget ticket at the same time, disrupting the order of the CUA official website;
(3)经旅客举报，有低价购票，高价倒卖行为，影响比较恶劣的；
(3) any passenger reported to be trading air tickets for profit, such a case will result in comparatively serious consequences;
(4)中国联航认为的造成比较恶劣影响的其它行为。
(4) CUA discovers any other acts that have a bad impact.
3.发生以下行为，注册会员账户永久停用：
3. The account of a registered member will be permanently disabled, if:
(1)使用注册会员号，为同一乘机人在一个航班或时间冲突的不同航班，两次及以上次恶意占座的；
(1) the registered member has held seats twice or more times for one passenger in one flight, or in different flights during different periods of time;
(2)抢购特价机票，并有两次及以上中国联航认为的故意退票的；
(2) the registered member has two or more times purchased budget tickets only to refund them out of what CUA considers as ill intentions;
(3)冒用他人并使用他人信息进行会员注册，造成真实信息持有人无法注册的行为，账号被停用后，此账号停用导致的所有损失，由账号注册人负责；
(3) the registered member has registered the membership by using other people's personal information, resulting in the owner of such personal information unable to register as a member. When the account is disabled, the person registering this account shall be held responsible for any losses arising from the disabling of such an account;
(4)经旅客举报，有低价购票，高价倒卖行为，影响恶劣的；
(4) any passenger reported to be trading air tickets for profit, such a case will result in comparatively serious consequences;
(5)中国联航认为的造成影响恶劣的其它行为。
(5) CUA discovers any other acts that have a severe impact.

4. Miscellaneous
中国联航有权利对会员义务、处罚措施进行更新。
CUA reserves the right to update the member obligations and penalties.
